Please read these Terms and Conditions carefully before purchasing, assembling, or using the KeyerBuddy DIY kit ("Kit"). By purchasing, assembling, or using the Kit, you ("You") agree to be bound by the following terms.
1. Disclaimer of Warranties
The Kit and all its components are provided 'as is' and 'with all faults', without any warranties, expressed or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The seller and creator ("Seller") do not warrant that the Kit will be free from defects, that the assembly instructions (if provided) are error-free, or that the assembled device ("Device") will function correctly. The quality and functionality of the final assembled Device are entirely dependent on your skill and the assembly process.
2. Safety Warning and Assumption of Risk
This is a DIY electronics kit that requires technical skill, including but not limited to soldering, component identification, and basic electronics knowledge. You explicitly acknowledge and agree that:
- The assembly process carries risks, including but not limited to risk of personal injury (e.g., burns from a soldering iron, cuts from component leads) and risk of electric shock.
- Improper assembly can lead to failure of the Device, damage to the Kit's components, and damage to other property, such as computers, radios, or testing equipment.
- You are solely responsible for providing a safe assembly environment (e.g., proper ventilation, fire safety) and using appropriate tools and safety equipment.
- The Kit is not a toy and is not intended for use by children without direct, qualified adult supervision.
By proceeding with assembly, you voluntarily assume all risks associated with the assembly and use of the Kit.
3. Limitation of Liability and Indemnification
You agree that you buy, build, and use the Kit and the final assembled Device entirely at your own risk. You agree to take full responsibility and liability for any and all damages that may arise from its assembly or use.
To the fullest extent permitted by law, the Seller shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:
- Personal injury, property damage, or death.
- Damage to your tools, workbench, or other personal property.
- Damage to connected any third-party equipment (such as headphones, speakers, computers, phones, morse keys, etc.).
- Loss of profit, data, or use.
- Any damages resulting from your lack of skill, improper assembly, misuse, modification, or failure to follow instructions.
You agree that the Seller's maximum total liability to you for any and all claims related to the Kit shall not, in any circumstance, exceed the total amount you paid for the Kit.
You agree to indemnify, defend, and hold harmless the Seller from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your assembly, use, or misuse of the Kit and the assembled Device.
4. Returns Policy
A Kit may be returned for a full refund of its purchase price within 30 days of the date of delivery, subject to the following conditions:
- The Kit must be unused, unassembled, and in its complete, original state.
- All components must be present and in their original condition (e.g., no components have been soldered, no leads have been cut, and components are in their original packaging where applicable).
- You must contact the Seller to initiate the return and are responsible for all return shipping costs.
Once assembly of the Kit has been started, it is no longer eligible for a return. The Seller reserves the right to inspect the returned Kit and refuse a refund if the Kit is found to be incomplete, assembled, or damaged.
5. Intended Use
The Kit is intended for use only for its specified purpose as a morse code practice device. Any use outside of this intended purpose, or any modification of the Device's design, is done at your sole risk, and the Seller disclaims all liability for such use.
6. Open Source License
The software (firmware code), 3D-printable enclosure models, and PCB (Printed Circuit Board) designs ("Designs") associated with the Kit are released as open source.
- The software is licensed under the GPLv3 License.
- The enclosure models and PCB designs are licensed under the Creative Commons BY-NC 4.0 License.
This Open Source License applies ONLY to the digital Designs and software code. It does not apply to the physical components included in any purchased Kit. The terms "Disclaimer of Warranties" (Section 1) and "Limitation of Liability" (Section 3) apply equally to the open-source Designs. The Designs are provided 'as is', without warranty of any kind, and the Seller disclaims all liability for any use, modification, or distribution of the open-source Designs.
7. General
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
